Schwarzenegger seeks court injunction against Chiang

The court battle over the size of state worker paychecks continues.

The Schwarzenegger administration submitted a court petition Tuesday in Sacramento County Superior Court seeking an injunction to force state Controller John Chiang to slash the wages of roughly 200,000 state workers.

Schwarzenegger has ordered the wages of state employees cut to $7.25 an hour until a budget is signed. A state appeals court agreed that the governor had the authority to do so last week, but Chiang, a Democrat, has continued to fight the directive.

In the filing, the Schwarzenegger administration argues that judicial relief is urgently needed because the states payroll system must be adjusted before July 22 to change the size of paychecks in the July pay period.

Unless restrained prior to this cut-off date, [Chiang] will unlawfully issue full salaries to state employees, said the filing, made by Department of Personnel Administration Director Debbie Endsley.

The budget year began Thursday. Once a budget is signed, workers would be entitled to their full back pay.

COMMENT:
Chiang represents yet another violation against 'We the people' violating California Order from our Governor.  We also have 1-sided, Democratic Progressive state legislators declaring a boycott against another Sovereign State because illegal aliens are just that determined by United States Code. And the One-sided, all-knowing world of baseball, like football deciding that they know more about illegal aliens  and discrimination than 60 to 75% of the American people!

Then there's the Los Angeles City Council deciding in all their power-one sided, self-serving need for Democratic votes, deciding they need to join the game called "Saul Alinsky's  "Rule 11: Pick the target, freeze it, personalize it, polarize it. Don’t try to attack abstract corporations or bureaucracies. Identify a responsible individual. Ignore attempts to shift or spread the blame."

Not One of these groups, elected or appointed have the support of 'We the People'!  REMEMBER IN NOVEMBER EVERY SINGLE PERSON INVOLVED...POINT TO THEM AS THEY SPEAK TO RE-RUN FOR OFFICE. MAKE THEM UPHOLD THE CONSTITUTION BOTH STATE AND FEDERAL.

Chiang says he can't change the paychecks in 15 days. Computers can. If he can't with his computers, he better use a desktop with Microsoft spread sheet because 100% of the checks are the same except the payee.

That we taxpayers have to pay back the CA employees after the Budget is signed,is just the continuing saga of 'Closed Shop Unions' at every level of government in probably more than three/quarters of the States in our Nation...believing that US Citizens have a bottomless pit of money; and that if we run out--just print some more!!:-(  That way union-member Citizens get hurt thrice: twice as taxpayers and once more as union members! We wouldn't talk about their taxpayer-based retirement plans, because of the Union's belief that the public sector of business Always Gives Retirement Plans! Talk about:  "(2) A statute, court rule, or other authority, including those in effect on the effective date of this subdivision, shall be broadly construed if it furthers the people's right of access, and narrowly construed if it limits the right of access.  A statute, court rule, or other authority adopted after the effective date of this subdivision that limits the right of access shall be adopted with findings demonstrating the interest protected by the limitation and the need for protecting that interest." AND "(b) A citizen or class of citizens may not be granted privileges or immunities not granted on the same terms to all citizens. Privileges or immunities granted by the Legislature may be altered or revoked."(California Constitution Article I).

Nothing like ignorance and disdain to add to violations of Constitutional Law or Law to protect the Individual (business is an individual) From a few Legislative members with too much power and No Restraint in Spending Other People's Money!

My only question remains the same as Glenn Beck's, besides REMEMBER IN NOVEMBER: Everyone who loves American, her history, the sacrifices of its many wonderful leaders from landing the Mayflower through the work of our State Department and Troops Today in both Iraq and Afghanistan, It Is Up To US(A) each and everyone of US(A) to renew our belief in "In God We Trust", Nature and Nature's Law, Endowed by our Creator, It is Our Duty to.., ..They too have been deaf to the Voice of Justice and of Consanguinity*. God and ethics with Truth remains and Shall Always be the Source of each Individual who supports our Declaration and Constitution!!!


*It is always important to look up words in The 1828 American Dictionary: it sits on your computer and is very easy to use. Frequently, need to compare to an Oxford Dictionary to narrow the time distance between 1779 and 2010!
